1. Who we are
Margin ("Margin," "we," "us," or "our") is a software service operated by Fitness Family LLC, a Maryland limited liability company. By creating an account, accessing, or using Margin (the "Service"), you ("you," "your," or "Customer") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. What Margin does
Margin is a financial-analysis tool that helps medical and other practices understand the profitability of their services — including metrics such as profit per provider-hour — based on the data you enter or connect. Margin produces calculations, comparisons, and suggested actions for informational purposes only.
3. Not professional advice
Margin is a software tool, not a financial advisor, accountant, tax professional, attorney, or consultant. The outputs, insights, rankings, and suggested actions Margin provides are informational and educational only. They do not constitute financial, accounting, tax, legal, investment, or business advice, and should not be relied upon as a substitute for the judgment of qualified professionals who know your specific circumstances. You are solely responsible for any decisions you make and any actions you take based on the Service. We strongly recommend you consult your own accountant, attorney, or financial advisor before making business decisions.
4. Your account
You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. You must be at least 18 years old and authorized to bind the practice or business on whose behalf you use the Service.
5. Your data
You retain ownership of the data you enter into or connect to Margin ("Customer Data"). You grant us a limited license to store, process, and use Customer Data solely to provide and improve the Service. You represent that you have the right to provide any data you submit, and that you will not submit protected health information (PHI), patient-identifiable medical records, or other data that would subject either party to HIPAA or similar health-data regulations. Margin is designed for practice business and financial data only. Our handling of your data is described in our Privacy Policy.
6. Subscriptions, billing, and renewal
The Service is offered on a subscription basis. Plans and current pricing are shown at sign-up. Key terms:
- Free trial: New subscriptions may include a 7-day free trial. If you do not cancel before the trial ends, your subscription will begin and your payment method will be charged.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, and your payment method will be charged automatically, until you cancel.
- Cancellation: You may cancel at any time through your account or by contacting us. Cancellation stops future renewals; it takes effect at the end of the current billing period.
- Refunds: Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
- Price changes: We may change prices; we will give notice before a change affects you, and continued use after the change means you accept the new price.
Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.
7. Acceptable use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to access, probe, or breach the Service's security or other customers' data; (c) reverse-engineer, copy, resell, or create derivative products from the Service; (d) upload malicious code or interfere with the Service's operation; or (e) submit PHI or data you are not authorized to share. We may suspend or terminate accounts that violate these Terms.
8. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. The Service is provided on an ongoing development basis and features may change.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CALCULATIONS, INSIGHTS, OR RECOMMENDATIONS PRODUCED BY THE SERVICE ARE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR CIRCUMSTANCES.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITNESS FAMILY LLC AND ITS OWNERS, MEMBERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Fitness Family LLC and its owners and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your Customer Data, or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Maryland, and you consent to that jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.
